Feds plan review of MTR

Dare we hope?

WASHINGTON (AP) - The Obama administration on Thursday announced steps to reduce the environmental destruction caused by mountaintop coal mining in six states.

The government will seek to eliminate the expedited reviews that have made it easier for mining companies to blast off Appalachian mountaintops and discard the rubble into valleys where streams flow.

The agreement among three federal agencies also includes changes to tighten federal oversight and environmental screening of the mountaintop coal mining in Kentucky, Ohio, Pennsylvania, Tennessee, Virginia and West Virginia.

"The Obama administration has serious concerns about the impacts of mountaintop coal mining on our natural resources and on the health and welfare of Appalachian communities," Sutley said. "Within this plan the Obama administration is doing at all it can under existing laws and regulations to curb most environmentally destructive impacts of mountaintop coal mining."

A spokeswoman for the National Mining Association said the industry was not consulted on the deal and had not seen it. "We are disappointed this was not a fully transparent process and that the concerns of those closest to surface mining operations were not fully aired," Carol Raulston said.

No seriously, is this too good to be true?

Jeff Biggers is the man and is on it. The reviews are mixed, to say the least.

Teri Blanton, Kentucky: "I would say today's annnouncement is encouraging but we will have to wait and see if this is going to be good or bad. I would also like to add that we welcome them to come to Appalachia and hear from the communities being impacted by this method of mining. MTR is just a symptom of a much bigger problem this industry has worked outside of the law for over 100 years.  Engineers who have been disgusted with the industry and that have joined our cause have said repeatedly that if there was a new regulation the industry would not work to abide by it but rather how to get around it.  This has to stop.  ...

Judy Bonds, Coal River Mountain Watch: "The Obama administration's announcement is pure political subterfuge.  Scrutiny is another term for "smoke and mirrors." Obama's new motto is "Yes we can-blow up Appalachia." How will Obama fix the problems that the residents must deal with? I am truly disappointed in President Obama's bait and switch campaign lies. Obama says he wants to protect streams but a mountaintop removal permit is filling in streams. I challenge President Obama to bring his family and come to West Virginia and live near the blasting and breathe poison air and drink poison water that we mountaineers are forced to live with."

The sky hasn't started falling in Charleston - yet.

If these folks aren't happy, it must mean good things.

This announcement gives our officials the opportunity to show progressive policy in joining with the Feds in diversifying the economy of our coalfields.  It is time to swallow that bitter realization that we won't have coal to support us forever, and we must take action now to leave our future generations of Mountaineers the mountains and streams that make us who we are, but also well-paying jobs in industries that benefit everyone.

I hope leadership rises above manipulative politics.

Earlier this evening Gov. Joe Manchin issued the following statement about the Obama Administration announcement:

ABOUT OBAMA ADMINISTRATION'S ANNOUNCEMENT TODAY

CHARLESTON, W.Va. - Gov. Joe Manchin and DEP Secretary Randy Huffman released this statement today about the Obama Administration's action to strengthen oversight and regulation for surface mining:

Gov. Joe Manchin explained, "Early this morning, I spoke with chair of the White House Council on Environmental Quality Nancy Sutley and EPA Administrator Lisa Jackson about today's announcement; I shared my concerns about how this decision impacts West Virginia families.

"I think that we all agree that surface mining must have proper oversight. As I have said before, with a new administration comes new policies and this administration has the right to evaluate past policies to determine where improvements can be made."

DEP Secretary Randy Huffman noted, "While the federal government in its evaluation might have determined that minimal oversight was used previously in federal regulation regarding surface mining, in West Virginia we have used and will continue to use a high standard of oversight.  West Virginia has significantly increased its regulatory standards for surface mining since we gained primacy over the Surface Mining Reclamation and Control Act in the early 1980s, and will continue to make changes as information is gathered and technology changes. The EPA, Department of the Interior, and the US Army Corps of Engineers believe their part of the regulatory process needs more attention and we will be paying very close attention to the changes they propose."

Gov. Joe Manchin added, "I have always said that mining is vital to West Virginia's economy, but at the same time, we must constantly look for ways to improve mine safety and operate in an environmentally responsible way. That is why today I asked EPA Administrator Lisa Jackson to examine our Post-Mine Land Use legislation that was recently passed in the special session. I explained how responsible this piece of legislation is and how it will assist us in finding the balance between protecting our environment and protecting our jobs.

"We will continue to work with the federal government to ensure that coal companies comply with environmental regulations every step of the way, so that the environment is protected while the West Virginia economy stays strong and our people stay working. We also ask for the administration to work with us to find the balance between our economy and our environment.

"I truly believe that coal is essential in meeting our nation's energy needs and keeping our economy strong and competitive, while allowing our country to be less dependent on foreign oil and more secure. Rest assured, I will continue to do everything I possibly can to fight for West Virginia families and the jobs that support them."

Both Gov. Joe Manchin and DEP Secretary Randy Huffman, with their staffs, will continue to evaluate the MOU in the coming days.  

What I don't understand is if things really are as Sec. Huffman says, "in West Virginia we have used and will continue to use a high standard of oversight.  West Virginia has significantly increased its regulatory standards for surface mining since we gained primacy over the Surface Mining Reclamation and Control Act in the early 1980s" then why does the Governor feel the need to share his "concerns" about the Obama Administration's action to strengthen oversight and regulation for surface mining?

Perhaps, WV DEP isn't doing as well as they claim?  Nah, that couldn't be it.  Could it?

In a good conversation everyone speaks.  In a great conversation some even listen.

The letter is on her stationary. Her and Rep. Shimkus (R-No More Floods) [Tell that to the Eskimos! I have read Genesis and Matthew, but would have never relied on Sacred Scripture as my sole study guide for a chemistry or physics midterm exam.] Hard to miss their signatures on the bottom of page one. There are eleven signatures from coal states.

I have NEVER seen her at a Select Committee on Energy Independence and Global Warming hearing. Five percent from MTR, folks, 5%. That would be easy to repalce with wind, etc. Shelley majored in zoology at Duke. Does she agree with Rep. Shimkus and therefore just cribs his notes? [as of now Ranking Sensebrenner does not list her.]
